Terms and Conditions

The purpose of this document is to outline the Terms and Conditions of your membership to CrossFit Bytown (hereafter referred to as ‘CFB’). By signing and dating this document, you are acknowledging and agreeing to the policies in place mandated by the CFB Management Team. CFB reserves the right to update, modify or revise these terms and conditions as necessary. For your reference, a current Terms and Conditions is located on our website at www.crossfitbytown.com.

To become a member of CFB you must agree to the following by acknowledging each page with your initials, in addition to signing and dating this document.

Release of Liability
CLIENT’S ACKNOWLEDGEMENT AND ASSUMPTION OF RISK AND FULL RELEASE FROM LIABILITY OF CROSSFIT BYTOWN: CLIENT ACKNOWLEDGES THAT THE PERSONAL TRAINING/NUTRITIONAL SERVICE PROGRAMS PURCHASED HEREUNDER INCLUDES PARTICIPATION IN STRENUOUS PHYSICAL ACTIVITIES, INCLUDING, BUT NOT LIMITED TO, RUNNING, WEIGHT TRAINING, STATIONARY BICYCLING, GYMNASTIC MOVEMENTS, VARIOUS AEROBIC CONDITIONING MACHINERY AND VARIOUS NUTRITIONAL PROGRAMS OFFERED BY CROSSFIT BYTOWN (THE “PHYSICAL ACTIVITIES”). CLIENT ACKNOWLEDGES THESE PHYSICAL ACTIVITIES INVOLVE THE INHERENT RISK OF PHYSICAL INJURIES OR OTHER DAMAGES, INCLUDING, BUT NOT LIMITED TO, HEART ATTACKS, MUSCLE STRAINS, PULLS OR TEARS, BROKEN BONES, SHIN SPLINTS, HEAT EXHAUSTION, KNEE/LOWER BACK/FOOT INJURIES AND ANY OTHER ILLNESS, SORENESS, OR INJURY, HOWEVER CAUSED, OCCURRING DURING OR AFTER CLIENT’S PARTICIPATION IN THE PHYSICAL ACTIVITIES. CLIENT FURTHER ACKNOWLEDGES THAT SUCH RISKS INCLUDE, BUT ARE NOT LIMITED TO, INJURIES CAUSED BY THE NEGLIGENCE OF AN INSTRUCTOR OR OTHER PERSON, DEFECTIVE OR IMPROPERLY USED EQUIPMENT, OVER-EXERTION OF A CLIENT, SLIP AND FALL BY CLIENT, OR AN UNKNOWN HEALTH PROBLEM OF CLIENT.
CLIENT AGREES TO ASSUME ALL RISK AND RESPONSIBILITY ARISING FROM PARTICIPATION IN THE PHYSICAL ACTIVITIES. CLIENT AFFIRMS THAT CLIENT IS IN GOOD PHYSICAL CONDITION AND DOES NOT SUFFER FROM ANY DISABILITY THAT WOULD PREVENT OR LIMIT PARTICIPATION IN THE PHYSICAL ACTIVITIES. CLIENT ACKNOWLEDGES PARTICIPATION WILL BE PHYSICALLY AND MENTALLY CHALLENGING, AND CLIENT AGREES THAT IT IS THE RESPONSIBILITY OF CLIENT TO SEEK COMPETENT MEDICAL ADVICE REGARDING ANY CONCERNS OR QUESTIONS CONCERNING THE ABILITY OF CLIENT TO TAKE PART IN CROSSFIT BYTOWN PHYSICAL ACTIVITIES. BY SIGNING THIS AGREEMENT, CLIENT AFFIRMS THAT HE OR SHE IS CAPABLE OF PARTICIPATING IN THE PHYSICAL ACTIVITIES. CLIENT AGREES TO ASSUME ALL RISK AND RESPONSIBILITIES FOR EXCEEDING HIS OR HER PHYSICAL LIMITS.
CLIENT, ON BEHALF OF CLIENT, HIS OR HER HEIRS, ASSIGNS AND NEXT OF KIN, WAIVES ANY CLAIMS AGAINST AND RELEASES CROSSFIT BYTOWN (AS WELL AS ANY OF ITS OWNERS, EMPLOYEES, OR OTHER AUTHORIZED AGENTS, INCLUDING INDEPENDENT CONTRACTORS) FROM ANY AND ALL LIABILITY, CLAIMS AND/OR CAUSES OF ACTION THAT CLIENT MAY HAVE FOR INJURIES OR OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO PUNITIVE DAMAGES, ARISING OUT OF PARTICIPATION IN CROSSFIT BYTOWN ACTIVITIES, INCLUDING, BUT NOT LIMITED TO THE PERSONAL TRAINING/NUTRITIONAL PROGRAMS AND THE PHYSICAL ACTIVITIES.

Personal Training
All personal training sessions require a full 24 hours notice for cancelation to avoid incurring the cost of the session. If a member cancels a session with less than 24 hours notice, the full cost of the session will be charged.

Monthly Memberships
A Monthly Membership is a contractual agreement allowing us, CFB, to automatically withdraw membership dues for the agreed upon duration by you, the client. There will be no refunds given.

Should you, the client, choose not to complete your contract, it is your FULL responsibility to fulfill your financial obligations. You will have two options:

Rules on Membership
All membership options entitle the member to train at either 2 times (2) or an unlimited number of classes per week, contingent on membership type and given that all payments are current. Clients will be grandfathered in to their rate if they wish to renew beyond their initial contract unless otherwise noted by the most current terms and conditions.
All members must fulfill their financial obligations of their contract. Written notice is required if you choose not to renew with CFB. In other words, if your contract is coming due on November 30th, 2013 and you wish to cancel your membership, you will need to provide written notice to CFB by November 20th, 2013 informing them of your decision. If you do not inform CFB of any membership changes 10 days prior, your contract will AUTO RENEW at the existing contractual agreement. It is your sole responsibility to remember when your contract expires. You can cancel stop the renewal of your own membership through the website or app. If this is the case, written notice is not required.

Refund Policy
There are no refunds to any of our products and services…ever (that is unless we made a billing error).

Exceptions
These are at the sole discretion of the CrossFit Bytown owner, which will be reviewed only if provided in writing.

Delinquent Accounts
All members under the Monthly Membership plan will be enrolled in an automatic payment plan. If the client’s account balance cannot cover the amount of the membership dues, the client will have seven (7) days to make their late payment in full without paying a re-initiation fee. If the client has not paid his or her dues by the said deadline, the membership will be suspended and the client will be subject to a $50 re-initiation fee to reactivate the membership in addition to paying that month’s fees.
To cover our charges there will be a $25 NSF/Decline charge billed to the member should their payment method not be approved. This charge will be billed for each time the payment is attempted.

Gym Etiquette
The CrossFit Bytown team works hard to provide a space for members to have a top notch training facility. CrossFit members pay for and deserve ongoing and consistent enjoyment of the facility. We have high standards and values that we expect our staff and members to comply with. Our Values are:


Quality: Combined, our coaches have over 20 years of experience, providing our clients with the best training possible.
Safety: All movements are executed in a safe and precise manner.
Respect: Respect your coaches, your peers, the equipment and facility. When the coach is talking please be quiet.
Support: Encourage each other to succeed. There is give and there is take.
Fun: Do not take yourself too seriously. This is our fun and always will be.
Development: CrossFit is as much mental strength as it is physical, and through this we develop into our best selves.

Please be on time for class, and respect the coaches and class structure. You may not stop in and train at your own leisure. Group Classes, are just that-Group Classes. If you wish to work on a technique or skills, please review the CFB schedule for Classes marked “Open Gym”.

Storage and Liability
CrossFit Bytown has provided cubby areas for you to place your belongings in. Please note that CrossFit Bytown is not liable for broken or missing belongings. It is mandatory to place all belongings into a cubby, as items left on the floor is prohibited due to safety concerns and space. If you do not feel comfortable leaving your valuables in a cubby during class, please leave them at home. Personal belongings left behind will be kept for seven (7) days in the lost and found.

Photography
As a way for CrossFit Bytown to promote the facility and share experiences gained by our members, periodically we use the expertise of a professional photographer. By signing this contract, you are authorizing CrossFit Bytown to use your photograph and likeness for business purposes. In the event that you would like to opt out of being photographed, it is your responsibility to inform the photographer directly.

Age Requirement
We suggest members be 18 years of age or older to participate in CrossFit Bytown group classes. If members do not meet this requirement a parental signature will be required*.

Legal
The client’s signature on this membership agreement confirms that CrossFit Bytown will charge the payment method (credit card or EFT submitted by the member) for any dues, sales and fees owed under this contract. Additionally, the member agrees to the above Terms and Conditions, as well as updated conditions on the CFB website that will be made at the discretion of the CFB Management Team. CFB will make the necessary announcements in regard to changes, but it will be the client’s responsibility to stay current with the information.

This membership agreement is executed in conjunctions with the Waiver. Both documents must be completed in full prior to becoming a CrossFit Bytown Member.
